Who Killed Kugan?


Who killed Kugan?
Did Kugan die because of police brutality?

These two vital questions need to be answered
in the light of the new second postmortem.

A.Kugan,22, should not die in vain.

Apparently,he was severely beaten to death while in police custody in January this year.

The culprits should be arrested and charged with murder.

A.Kugan was a suspect in connection with a luxury car theft syndicate.

But one must respect the rule of law and basic 
principles of justice.

No one,especially police should take the law into their own hands and pass prior judgement.

In the eyes of the law, everyone is innocent until he or she is proven guilty in court.

The police attempt to cover up a major case of abuse of power,torture and excessive use of force in 
interrogation has now blown up into a vital issue of public interest and concern.

On Wednesday (March 4,2009),Kugan's family handed the findings of the second postmortem to the Attorney-General Chambers for appropriate action to be instituted for justice to be done.

Kugan's family lawyer N.Surendran had held a press conference at the People Justice Party (PKR) headquarters the day before to reveal the shocking findings.

Kugan's body had 42 marks and contusions.

He apparently was branded like a cow.Among the burn marks were V-shaped burn marks believed to have been caused by a hot iron.

Kugan would have suffered "blunt force trauma" from
the brutal torture and beatings he sustained on his body.

His muscle tissues broke down,made their way to his blood stream and kidneys resulting in rhabdomyolysis ~acute renal failure.

This cause of death was given in the second postmortem performed by pathologist Dr.Prashant N.Samberkar of University Malaya Medical Centre(UMMC) at 9 a.m. on January 25,2009.

It is in sharp contrast with the first postmortem done at the Serdang Hospital that found Kugan died of pulmonary oedema or fluid accumulation in the lungs.

"I hope the police hang their heads in shame, institute reforms and stop putting obstacles in the implementation of the Independent Police Complaints and Misconduct Commission(IPCMC)," stresses
Surendran.

The pathologist also found Kugan's stomach was empty which meant he was being starved before he collapsed and died from the severe beating.

Police arrested Kugan On January 14,2009 and interrogated him for alleged car theft at the Taipan police station in USJ,Subang Jaya.

He died in police custody on January 20,2009.

His family and friends entered the Serdang mortuary the same night and took photographs and video footages of his body.

Deputy Minister in the Prime Minister's Department
Senator T. Murugiah,who oversees the Public Complaints Bureau,rushed there about an hour later.

He was followed by another Deputy Minister in the Prime Minister's Department Datuk S.K.Devamany 15 minutes' later.

Selangor police chief deputy commissioner Datuk Khalid Abu Bakar had claimed there was no foul play.

The state police chief had stated Kugan died of breathing difficulties.

He had also threatened to take action against the two deputy ministers and Kugan's family and friends
for trespass into the mortuary.

And Home Minister Datuk Seri Syed Hamid Albar warned the government would not hesitate to take action against them if they were found to have broken the law.

This prompted Malaysian Indian Comgress(MIC) President Datuk Seri S Samy Vellu to stress that "we will hire as many lawyers to defend them if they are charged in court".

Stressing the incident had tarnished the National Front's name, the former Works Minister urged Syed Hamid to check the "real facts before speaking out".

"We know exactly what happened there. It is untrue that they barged in.

"Syed Hamid should go after the people who are responsible for Kugan's death and not after the two deputy ministers who want to fight for the community,"he added.

To put the facts right,Kapar MP S. Manikavasagam and lawyer N.Surendran also lodged police report at Brickfield police station against the state police chief for making false statement.
  
Police quizzed and recorded statements from the two deputy ministers,Kugan's six family members ~ his father G.Ananthan,mother N.Indra,two aunts,an uncle and a brother-in-law ~ and Police Watch and Human Rights committee member S.Jayathas for alleged mortuary intrusion.

At one stage,police investigated them for tampering,concealing evidence,trespassing,breaking in and criminal intimidation. 

They were represented by Kapar Member of Parliament(MP) S.Manikavasagam,Puchong MP Gobind Singh Deo and N.Surendran.

Nevertheless, based on the evidence, Attorney-General Tan Sri Abdul Gani Patail has classified the case as murder.

Democratic Action Party (DAP) chairman Karpal Singh has urged Abdul Gani to direct an immediate investigation into the Serdang Hospital pathologist for issuing a false postmortem report!

Truth has come to light because the Kugan's family entered the mortuary and took the photographs.

"This case highlights the need for independent inquiries - second postmortem reports on all death in custody cases," adds Gobind Singh Deo.

It definitely underscores the urgency to set up the IPCMC.

Inspector-General of Police (IGP) has urged the public to "wait for the outcome of police investigations" stressing police would "not hide anything".

Well, now that the findings of the second postmortem are out, stern and prompt action must be taken as soon as possible. 

Surprisingly, police did not asked for an inquest into the death of Kugan in police custody.

DAP adviser Lim Kit Siang,PKR adviser Datuk Seri Anwar Ibrahim and human rights activists have called for a royal commission of inquiry to do an indepth probe,find the root cause and prevent a recurrence of police brutality.

Meanwhile,Federal CID director commissioner Datuk Seri Mohd Bakri Zinin assured there would be no police cover up and justice would be seen to be done.

Leaders of MIC,Malaysian Bar Council,Malaysian Chinese Association
(MCA) and Gerakan have also expressed concern over the new evidence revealed in the second postmortem.

MCA youth and legal 
affairs parliamentary research bureau chief Wong Nai Chee urged police to reveal the results of its internal probe and take the necessary action 
against the perpetrators soonest possible.

Wong said MCA also wanted to know the action to be taken by Serdang Hospital to account for the discrepancies between its postmortem and the second postmortem.

Yesterday (March 6,2009), Kugan's family lodged a police report at Petaling Jaya district police headquarters against Serdang Hospital director Dr. Mohd Norzi Ghazali and pathologist Prof. Dr.Abdul Karim Tajuddin for alleged false postmortem report to cover up the death of Kugan.

In the light of fresh evidence,Malaysian Medical Council(MMC) must also take proper disciplinary action against those responsible for fabricating medical evidence in postmortem report.
